How will I know if I’ve won? The winners will be contacted by email and may also be contacted by phone within seven (7) business days of the draw. For the purposes of public statements and advertisements, GEARWRENCH may only publish the winner’s surname, initial and State/Territory or postcode of residence.
When do I need to claim my Prize by? All Prizes must be claimed by 12:00pm AEST on 12 April 2023.
How will I receive my Prize? The main prize winner must collect the Sea-Doo Spark from National Storage, 1829 Creek Road, Cannon Hill 4170, if they reside in QLD. If the winner resides outside of QLD, the Promoter will arrange for the delivery of the Sea-Doo Spark to their nominated postal address. GEARWRENCH will arrange couriers to deliver the 2nd, 3rd and weekly prizes to the winners, with an estimated delivery time of 1-2 weeks depending on location.
Can I enter more than once on the same day? Multiple entries permitted, subject to the following:

1. Information on how to enter and the prize(s) form part of these Terms & Conditions. Participation in this promotion is deemed acceptance of these Terms & Conditions.
2. Entry is only open to Australian residents aged 18 years or over.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. 13. All Weekly Draws will take place at Apex Tool Group Pty Ltd, Suite 201, Level 2, 184 Bourke Rd, Alexandria NSW 2015 at 1:00pm AEDST on 07/03/2023. The Major Draw will take place at Anisimoff Legal, 5/210 Central Coast Highway, Erina NSW 2250 at 1:00pm AEDST on 07/03/2023 in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by email and phone within seven (7) business days, and their names will be published online at https://www.gearwrench.com.au/gw-bunnings on 10/03/2023.
14.The Promoter’s decision is final and no correspondence will be entered into.
15. The first valid entry drawn from the Major Draw will win a Sea-Doo Jetski with custom modifications valued up to $14,099.00 including a REDCO single PWC trailer and two (2) JSW Powersports Nylon life vests. Trailer includes registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The winner must collect the prize from National Storage, 1829 Creek Road, Cannon Hill 4170, if they reside in QLD. If the winner resides outside of QLD, the Promoter will arrange for the Jetski’s delivery to their nominated postal address.
16. If the winner is, through any legal incapacity or otherwise, unable to register the trailer in their own name, then the winner may assign the trailer to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the prize is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.

20. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
21. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
27. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

Nothing in these Terms & Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). 30.The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. PRIVACY POLICY
This policy applies to all personal information collected by ATG relating to individuals such as clients, suppliers or other third parties.
Personal information is defined in the Privacy Act 1988 (Cth) (Privacy Act) as information about an individual who can be identified, or whose identity could be reasonably ascertained from the information.
This policy does not apply to associate records, which are defined in the Privacy Act as records of personal information relating to the employment of an associate. Examples of personal information relating to the employment of an associate might include information about training or performance management, the associate’s emergency contact details, the associate’s hours of work or wages or the associate’s tax or superannuation affairs.
1. Collection of personal information
Personal information collected and/or maintained by ATG must be relevant to the purpose for which it was sought, must be accurate, up-to-date and complete and must not intrude to an unreasonable extent upon the personal affairs of the individual to whom it relates.
Personal information must be obtained, maintained and managed fairly and with respect for the dignity of the individual to which it relates. Individuals providing information should be advised of the general purpose for which the information is sought, and how it may be used in the future.
At the same time, information supplied by individuals is expected to be, to the best of their knowledge, true and accurate.
2. Use and disclosure of personal information
ATG will not use or disclose personal information about an individual for a purpose other than the purpose for which that information was collected or a secondary purpose which the individual would reasonably expect the information to be used for.
Depending on the nature of the matter, the types of bodies to whom ATG may disclose personal information include the courts, the other party or parties to litigation, experts and barristers, the Office of State Revenue, the Registrar General and third parties involved in the completion or processing of a transaction.
In particular, ATG will not sell or otherwise provide unauthorised access to personal information to anyone. All associates who have access to personal information must not discuss such information unnecessarily, or sell, show or provide it to unauthorised persons inside or outside ATG.
Organisations seeking confirmation of employment or other personal information about a current or former associate are required to speak with someone within the Human Resources team.
3. Access to personal information
Associates may be provided with access to personal information for the sole purpose of performing their duties. In such cases, associates should take all appropriate security measures to protect against unauthorised access to personal information or accidental loss or damage to the same.
Access to personal information will be strictly on a “need to know” basis.
4. Correction of personal information
If an individual informs ATG that personal information held by ATG about the individual is not accurate, complete and up to date, ATG will take reasonable steps to correct the information so that it is accurate, complete and up to date.
If for some reason ATG and the individual disagree about whether the information is accurate, complete and up to date, ATG will, upon request by an individual, take reasonable steps to associate with the information a statement from the individual claiming that the information is not accurate, complete or up to date.
5. Access requests from individuals
Any requests by individuals for access to personal information about them held by ATG should be made in writing. An associate who receives such a written request should forward it to the HR Department immediately. Apex Tool Group, ANZ Updated 2021
ATG will attempt to fulfil such a request within 40 calendar days except where:
- providing access would have an unreasonable impact upon the privacy of other individuals;
- he request for access is frivolous or vexatious;
- the information relates to existing or anticipated legal proceedings between ATG and the individual and the information would not be accessible by their process of discovery in those proceedings;
- providing access would prejudice ATG in relation to negotiations with the individual;
- providing access would be unlawful;
- denying access is required or authorised by law; or
- providing access would be likely to prejudice an investigation of possible unlawful activity.
In circumstances where ATG denies an individual access to personal information, it will provide reasons for the denial.
6. Method of disposal
All information of a private, personal or confidential nature must be disposed of in a manner that ensures the privacy of the individual to whom it relates. Destruction will usually be by means of shredding and / or deletion from ATG’s systems.
